Criminal background checks are an important step in the hiring process, especially for positions involving public trust, the management of sensitive resources, or working with vulnerable individuals. They help assess risks and protect the organization’s integrity.

This screening must be properly managed to avoid discrimination. It is essential to specify which offences are incompatible with the position. For example, a conviction for fraud is relevant for a financial management role, but much less so for an artistic or manual position. This approach respects the principles of fairness, rehabilitation, and non-discrimination, while ensuring the organization’s safety and credibility.

Defining offences based on job responsibilities also promotes the inclusion of individuals with criminal records when their offences do not interfere with their duties. This contributes to a more just society, where reintegration is possible without compromising either security or trust.

Each position has been analyzed based on its security, confidentiality, and accountability requirements. This practice complies with section 18.2 of the Quebec Charter of Rights and Freedoms, which stipulates that a person may not be refused employment solely because they have been convicted of an offence unrelated to the job or have received a pardon.

This grid is intended to provide an analysis based on broad categories of criminal offences. Note that these categories can be modified and tailored to the organization’s or company’s needs, or even to a specific position.

It is crucial to carry out this exercise to reduce discrimination in employment or volunteer work, thereby complying with Article 18.2 of the Quebec Charter of Rights and Freedoms. In the event of a violation, legal action may be brought before the Human Rights Tribunal against employers who do not comply with the Charter.
